What Kasambahay should watch for
Below-minimum kasambahay wage
Kasambahay minimum wages are: PHP 6,000/month in NCR, PHP 5,000 in chartered cities, and PHP 4,000 in other municipalities. Your contract must meet these minimums.
Missing SSS/PhilHealth/Pag-IBIG
Under RA 10361, your employer MUST register you with SSS, PhilHealth, and Pag-IBIG and pay the employer share. This is not optional.
No rest day provision
You are entitled to at least one rest day per week. If you work on your rest day, you should receive additional compensation.
No written contract at all
The Kasambahay Law requires a written employment contract. Working without one means your rights are harder to enforce.
Common risk flags PlainDoc catches
No 13th month pay mentioned
Kasambahay are legally entitled to 13th month pay under PD 851. If your contract doesn't mention it, your employer still owes it to you.
Salary deductions for breakages
Employers cannot deduct from your salary for accidental breakage of household items. This is explicitly prohibited under RA 10361.
No provision for days off
You are entitled to at least 24 consecutive hours of rest per week. Contracts that don't specify rest days violate the Kasambahay Law.
