What the law says

Article 86 of the Labor Code is clear: every employee who works between 10:00 PM and 6:00 AM is entitled to a night shift differential of at least 10% of their regular wage for each hour of work performed during that period. This is a minimum — your employer can offer more, but never less. The premium applies per hour, so if you work only part of the night shift window, you still get the extra pay for those specific hours.

Who is covered and who is exempt

Most rank-and-file employees are covered, regardless of industry. However, Article 82 of the Labor Code exempts certain workers: government employees (covered by civil service rules instead), managerial employees (those who set and execute management policies), field personnel (those who work outside the office and whose hours cannot be determined with reasonable certainty), and domestic workers or kasambahay (covered by RA 10361 instead). If you are a regular employee with fixed working hours — even if you work from home — you are likely entitled to night shift differential.

How to calculate your night differential pay

The calculation is straightforward. Take your hourly rate and multiply it by 10% — that is your night differential per hour. For example, if your daily rate is PHP 695 (NCR minimum wage) and you work 8 hours per day, your hourly rate is about PHP 80.63. Your night differential is PHP 8.06 per hour worked between 10:00 PM and 6:00 AM. Over a full 8-hour night shift, that adds up to an extra PHP 64.50 per day. Over 22 working days in a month, that is roughly PHP 1,419 in additional pay.

Night shift plus overtime: the premium stacks

Here is where it gets better. If you work overtime during night shift hours, both premiums apply. Under the Labor Code, regular overtime earns a 25% premium on top of your hourly rate. Night shift differential adds another 10%. So if you work beyond 8 hours during the night shift window, you earn your regular rate plus 25% overtime plus 10% night differential — all stacked together. Your employer cannot tell you that overtime already includes the night differential. They are separate entitlements.

Night shift plus holidays: double stacking

Working a night shift on a regular holiday means even bigger premiums. On a regular holiday, your rate starts at 200% of your daily wage if you work. Add the night shift differential on top of that holiday rate. If you also work overtime on a holiday night shift, the overtime premium applies to the holiday rate, and the night differential applies on top of everything. These premiums are all legally required and cannot be substituted with "compensatory time off" unless you agree to it.
